% 04.10.2018 Mr.Rajiv Nayyar, learned Senior counsel for the plaintiff, on instructions and without prejudice to the rights and contentions of the plaintiff, states that the plaintiff would be satisfied if the defendant gives an undertaking that he would give four weeks prior notice to the plaintiff before obtaining approval from Delhi Excise Department. Learned counsel for the defendant, on instructions, states that he has no objection to it.
The statement made by both the counsel are accepted by this Court and the parties are held bound by the same. Registry shall prepare a decree-sheet accordingly.
It is clarified that this order shall not prejudice the rights of the plaintiff to file a fresh suit before an appropriate forum including this Court. It is further clarified that that this order shall not be treated as precedent in other matters filed by the plaintiff. Needless to say, the present order is also without prejudice to the rights and contentions of the defendant.
