% 20.03.2017 Present contempt petition has been filed alleging wilful disobedience of order dated 27th February, 2013 passed by a Division Bench of this Court in W.P.(C) No.2380/2003, whereby the penalty of stoppage of three increments without cumulative effect was inflicted upon the petitioner and the period during which the petitioner remained suspended during enquiry was not to be treated as entitling the petitioner to wages. It was further clarified that the said period would not be counted for any service benefit save and except to compute pensionable service.
Since the present proceedings arise from an order passed by the Central Administrative Tribunal (CAT) and the doctrine of merger applies, the present contempt petition and the applications are disposed of with liberty to the petitioner to file the contempt petition
before the CAT under Section 17 of the Administrative Tribunals Act, 1985. The rights and contentions of all the parties are left open. MANMOHAN, J MARCH 20, 2017 KA
