The suit property has been handed over to the respondent. Learned counsel for the petitioner does not press this petition. Application under Order XXXII Rule 3 CPC which contains the contents of the settlement duly supported by the affidavits of the parties will form a part of the decree inter se the parties by virtue of which the suit property having been handed over to the respondent. The parties have no claim left against one another. The purported sum of Rs.28 lakhs purported to have been deposited by the petitioner before this Court in the account of the Registrar General of this Court along with interest accruing on the said amount be returned to the petitioner. Petition disposed of.
Date of 29.01.2016 stands cancelled.
