Learned Counsel for the petitioner/defendant submits that he is not pressing the present petition as the matter is now fixed for evidence of the petitioner before the Trial Court. It is, however, submitted that the petitioner be permitted to raise all his contentions, as urged in the present petition, at the stage of final arguments in the suit. Therefore, it is prayed that the present petition be disposed of as withdrawn with this liberty. 3.
