This is a petition under Section 528 of BNSS, 2023 seeking quashing and setting aside of orders dated 04.05.2024 and 04.09.2024, passed by the learned trial Court in CT Case No. 24/2019, titled as, "Directorate of Enforcement Vs. Deepak Talwar".

Learned Senior Counsel appearing for the petitioner submits that by virtue of the said orders, applications preferred by the petitioner for grant of NOC for issuance of fresh passport has been dismissed and further application seeking recall of order dated 04.05.2025 and other directions to the respondent/ Directorate of Enforcement for bringing on record relevant The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. It has come to the notice of the Court that in terms of paragraph 4 of the OM of Ministry of External Affairs dated 06.12.2024, Central Government exercising the powers under Section 22 of the Passport Act, 1967 ["the Act"] exempts citizens who are facing criminal proceedings from operation of Section 6(2)(f) of the Act, subject to them producing the orders from the concerned Court permitting them to depart from India. 4.

Learned Senior Counsel seeks permission to withdraw the present petition with liberty to file an appropriate application before the concerned Court in the light of OM dated 06.12.2024.

The statement made by learned Senior Counsel is taken on record. The petition is dismissed as withdrawn with liberty, as prayed for. 6.

Once such an application is filed, learned trial Court shall decide such application on its merits.
