This is an application preferred on behalf of the Petitioners under Section 151 CPC for passing a decree in terms of the Memorandum of Settlement entered into between the parties on 12.02.2025 2.

This petition is filed on behalf of the Petitioners under Section 9 of the Arbitration and Conciliation Act, 1996 (1996 Act) seeking the following reliefs:- (i) Pass a decree for Rendition of Accounts, compelling the Respondent to provide detailed and accurate account of financial transactions for the loan amount disbursed to the Petitioners.

(ii) Pass an order seeming the sum of Rs. 2,98,44,506.48/- from the Respondent and directing the Respondent to deposit a Bank guarantee or issue a Fixed Deposit Receipt for Rs. 2,98,44,506.48/- and any additional amount and cost as determined through the rendition of accounts and deemed fit by this Hon'ble Court O.M.P.(I) (COMM.) 360/2024 Page 1 of 2 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. (iii) Pass an order restraining the Respondent from alienating, transferring, auctioning off or dealing with the securities in any way against which the dispute is in question."

During the pendency of the petition, parties have amicably resolved all their disputes and the present application has been filed to record the settlement between the parties and dispose of the petition. Memorandum of Understanding executed and signed between the parties on 12.02.2025, incorporating the terms of the settlement is filed along with the application. Court has perused the terms of the settlement and finds the same to be lawful.

Accordingly, application is allowed and disposed of taking on record the memorandum of settlement and accepting the same. O.M.P.(I) (COMM.) 360/2024 5.

In light of the order passed in I.A. 9379/2025 and in view of the settlement between the parties, this petition is disposed of. 6.

Settlement agreement shall form part of the order and the terms shall bind the parties thereto.

Date of 13.05.2025 stands cancelled.
