After arguments a pass-over was sought.

Counsel for the appellant states, on instructions, that the appeal be disposed of as not pressed.

Ordered accordingly, but as prayed appellant is granted time to vacate the suit premises on or before 15.8.2018. Appellant will, in the meanwhile, continue to clear all charges towards electricity, water, admitted rent, etc. Also, it is noted that this Court has not observed anything with respect to the issue of mesne profits which is pending disposal before the trial court.

Let the appellant file an affidavit of undertaking in this Court in terms of the present order within two weeks and on the appellant filing the undertaking and complying with the terms of the same, RFA 240/2018

appellant is granted time to vacate the suit premises on or before 15.8.2018.

The appeal is disposed of in terms of the aforesaid observations.
