% 03.06.2016 C.M.No.22723/2016 This is an application under Order 23 Rule 1 read with Section 151 CPC filed on behalf of the petitioner seeking withdrawal of the present petition in view of settlement arrived at between the parties. It is stated in the application that the petitioner and the respondent have agreed to settle their disputes which are the subject matter of the present petition and in view of said settlement the petitioner does not wish to pursue the present petition. It is further stated in the application that the petitioner seeks to withdraw the present petition out of its own free will and there is no force or coercion or fraud on the petitioner to withdraw the petition from the respondent. Counsel for the petitioner submits that the petitioner may be permitted to withdraw the present petition. The prayer is allowed and the application stands disposed of. The parties shall remain bound by the terms of the settlement.

RC.REV. 115/2015 In view of settlement arrived at between the parties, the petition stands dismissed as withdrawn.
