The petitioner has filed this petition under Article 226 of the Constitution for a direction upon the respondent - Delhi Jal Board ["DJB"] to install a fresh water meter in the name of the petitioner at his premises [property No. 1449/910, A/2, Street No. 8, Jagjivan Nagar, Loni Road, Shahdara, Delhi - 110093].

Ms. Malvi Balyan, learned counsel for the DJB, states upon instructions, that an attempt was made yesterday to install the water connection, but the petitioner requested that the connection can only be installed after the first week of November, 2024. 3.

accepted by the DJB, no further orders are required in this writ petition. 4.

Learned counsel for respondent No. 2 states that respondent No. 2 is, in fact, the owner of the premises in question and civil proceedings are pending between her and the petitioner, who is her nephew. It is the contention of respondent No. 2 that the petitioner is in unlawful occupation of part of the premises.

It is agreed by learned counsel for the petitioner and respondent No. 2 that the installation of a water meter in the name of the petitioner will be without prejudice to the rights and contentions of the parties in the pending civil suit and will not create any special equities in favour of the petitioner.

The petition is disposed of with the above observations.
