Though this appeal was disposed of as compromised vide order dated 17th November, 2015 but upon office note being put up, notice was issued to the parties.

The counsel for the respondent no.1 states that adjustment of admitted rent of Rs.33,062/- is to be given from the rate of mesne profits of Rs.39,000/- per month and hence the amount deposited by the appellant in this Court was the correct amount.

The counsel for the appellant also confirms the same. 4.

Both counsels also seek a direction that out of the amount of Rs.9,27,167/- deposited in this Court, a sum of Rs.3,12,312.12p be released to respondent no.1 and the balance amount be refunded to the appellant. 5.

The registry is accordingly directed.
