The present petition has been filed seeking regular bail in connection with FIR No. 95/2025 under Sections 20/29 of NDPS Act registered at PS Crime Branch, Delhi.

The case of the prosecution is that on a secret information received by ASI Sanjeev Kumar, a raiding party was constituted and the co-accused Jasbir Singh @ Jassi was intercepted near Singhu Border. From him charas weighing 965 gms was recovered, and he was arrested. 3.

submits that the incriminating circumstances pressed against the present petitioners are the call records showing connectivity between the petitioner and co-accused Jasbir and bank transactions with another co-accused Balraj. 4.
He submits that Balraj has not been arrested whereas recovery made from co-accused Jasbir Singh is only of intermediate quantity. 5.
He contends that there is no recovery whatsoever made from the present petitioner. He further contends that the petitioner is in judicial custody since 22.04.2025.

On being queried by the Court, Ms. Richa Dhawan, learned APP appearing on behalf of State, on instructions from the IO, fairly states that no recovery was effected from the present petitioner. 7.
Even the contraband recovered from the petitioner is, undisputedly, of intermediate quantity. Therefore, Section 37 of NDPS Act would not be applicable in the present case. The call details between the petitioner and co-accused Jasbir Singh and banking transactions between the petitioner and absconding co-accused Balraj, are not substantive piece of evidence, and their probative value will be considered by the learned Trial Court at an appropriate stage.

The petitioner is in custody since 22.04.2025 and investigation qua him is complete and the chargesheet has also been filed against him. 9.
On further being queried by the Court, the learned APP on instructions from the IO, states that the present petitioner does not have any previous involvements.

Considering the aforesaid facts and circumstances in totality, this Court is of the view that the petitioner has made out a case for regular bail. furnishing a personal bond in the sum of Rs.50,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/Special Court/JMFC/Duty JM, further subject to the following conditions: (a) Petitioner shall appear before the Court as and when the matter is taken up for hearing.
(b) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned. (c) The petitioner shall not come in contact with the witnesses or tamper with any evidence.

It is clarified that the observations made herein above are only for the limited purpose of deciding the present bail application and the same shall not be construed as an expression of opinion on merits of the case. 12.
The petition is disposed of.
