The present writ petition has been filed seeking directions to the respondent nos. 1 and 2, to take action against the illegal construction being carried out in the property bearing Nos. 1539, 1540, 1541, 1542 and 1543, Suiwalan, Darya Ganj, New Delhi-110002.

Learned counsel appearing for the petitioner submits that though different property numbers are mentioned, however, they constitute only one property/building.

Responding to the present writ petition, learned counsel appearing for the respondent no.1-Municipal Corporation of Delhi ("MCD"), submits that The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
earlier, in the year 2015 also, unauthorized construction was noticed in the property in question, which was booked on 12th October, 2015. He submits that pursuant thereto, partial demolition action was taken in the year 2015 itself. He submits that now, on account of the fresh unauthorized construction in the property in question, a Show Cause Notice dated 07th August, 2025, has been issued, and thereafter a Demolition Order dated 10th September, 2025, has already been passed.

Learned counsel appearing for the MCD submits that requisite action shall be taken against the unauthorized construction existing in the property in question after following the due procedure. 5.
This Court is also informed that a Work Stop Notice dated 07th August, 2025, has already been issued to the Station House Officer ("SHO"), Police Station, Chandni Mahal.

Considering the submissions made before this Court, the MCD is held bound to take action against the unauthorized construction being carried out in the property in question, in accordance with law. 7.
In case, of any further on-going construction in the property in question, the same shall be stopped forthwith by the concerned officials of the MCD, duly assisted by the Local Police.

In case the petitioner is aggrieved by any non-action on the part of the MCD, the petitioner shall be at liberty to approach the Special Task Force ("STF") as constituted by the Supreme Court, in terms of the orders passed by the Division Bench of this Court in the case of Devender Versus Govt. of NCT of Delhi and Ors., and other connected matters in W.P.(C) 1807/2018 and Fazruddin Versus DDA and Ors., in W.P.(C) 4649/2017. 9.

any action undertaken by the MCD, their right to seek their remedies, in accordance with law, is reserved.

With the aforesaid directions, the present writ petition stands disposed of.
