The learned counsel for the petitioner states as the assessment order has been passed, he intends to approach the Commissioner of Income Tax (Appeal) by withdrawing the writ petition.

Accordingly, the petition along with pending applications are dismissed as withdrawn.

Suffice to state that the period during which the petitioner was pursuing this writ petition before this Court, shall be excluded for the purpose of computing limitation in terms of Section 14 of the Limitation Act, 1963.
