% 22.09.2025 1.
This is the second application filed under Section 482 read with Section 528 BNSS on behalf of the applicant Karan for grant of anticipatory bail.
2.
The first application bearing No. 2322/2025 has been disposed of by the Coordinate Bench of this Court, issuing directions to the Investigating Officer ["I.O."] to give prior notice of 15 days before taking any coercive steps against the petitioner.
3.
Learned counsel for the petitioner states that notice has been issued by the I.O., and therefore, petitioner is apprehending arrest. 4.
Learned APP, appearing for the State, submits that petitioner is not cooperating in the investigation and that the I.O. has just issued three notices to the petitioner to join and cooperate in the investigation. However, no notice for taking coercive steps has been issued. The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. 5.
That being the position, there is no imminent threat of arrest of the petitioner. The application is therefore dismissed while reiterating that I.O. shall give prior notice of 15 days to the petitioner before taking any coercive steps and the same shall be subject to the petitioner's joining and cooperating in the investigation.
