O R D E R

The present writ petition has been filed seeking directions to respondent nos. 1 and 2, to take action with respect to the illegal construction and land misuse in Khasra No. 265/2 and 257/2, within Lal Dora, Village Bijwasan, New Delhi-110062, being carried out by respondent no. 3.

Today, learned counsel appearing for the Municipal Corporation of Delhi ("MCD") has handed over a copy of a Status Report in the form of synopsis, which is taken on record.

As per the Report of the MCD, the unauthorized construction existing in the property in question has already been booked and a Show Cause Notice has been issued on 22nd September, 2025, Further a Work Stop Notice under Section 344(2) of the Delhi Municipal Corporation Act, 1957 ("DMC Act") has also been sent to the Station House Officer ("SHO"), Police Station- Kapashera. Furthermore, sealing action has also been initiated by the MCD.

At this stage, learned counsel appearing for respondent no. 3 submits rd that a regularization application has been filed yesterday, i.e., 23 September, 2025.

Accordingly, the MCD is directed to consider the said regularization application of respondent no. 3 and pass appropriate orders after hearing the respondent no. 3.

The respondent no. 3 is bound to carry out any directions, as issued by the MCD, with respect to removal of any non-compoundable deviations. 7.

Considering the fact that the respondent no. 3 has already filed an application for regularization before the MCD, the MCD is directed to take appropriate action against the unauthorized construction existing in the property in question, subject to any orders that may be passed in the regularization application.

It is further directed that no coercive action shall be taken against the property of respondent no. 3, during the pendency of the regularization application.

Needless to state, the respondent no. 3 shall not carry out any further unauthorized construction in the property in question. 10.

MCD, their right to seek their remedies in accordance with law is reserved. 11.

Accordingly, with the aforesaid directions, the present writ petition is disposed of.
