It is pointed out that in terms of the departmental order dated 16.07.2024, the dispute between the parties has already been referred to the Arbitrator. Learned counsel appearing for the petitioner points out that an additional escalation claim of ₹40,56,990/- with interest was not included in the final bill paid by the respondent, and therefore, even the said dispute has arisen which is incidental and ancillary to the fundamental dispute which is already under adjudication by way of arbitration. The petitioner, therefore, prays for reference of the said dispute, as well, to the same Arbitrator. 2.

The Court on 06.10.2025 directed for issuance of notice. Thereafter, on 13.11.2025 Mr. Surendra Godara, the official in-charge appeared on behalf of the respondent and prayed for some time. Today, the matter was called out and none appeared for the respondent. 3.

even this additional claim which has arisen between the parties is capable of being adjudicated by the same Arbitrator. Therefore, the same is referred to the already appointed Arbitrator.
