The present writ petition has been filed seeking directions to the respondent nos. 1 to 4, to take action against the illegal and unauthorized construction, being carried out by respondent nos. 6 and 7 in the property bearing House No. B-4, Khasra No. 372/184, Paryavaran Complex, Saidulajab, New Delhi-110030.

Learned counsel appearing for the petitioner submits that the property in question was sealed on 25th October, 2024. However, subsequently, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

respondent nos. 6 and 7, have tampered and broken the said seal and are carrying out further unauthorized construction. 3.

Responding to the present writ petition, learned counsel appearing for the respondent-Municipal Corporation of Delhi ("MCD") confirms the fact that the seal in the property in question has been broken and that further unauthorized construction is being carried out. 4.

He submits that the MCD is already in the process of taking requisite action against the respondents for tampering and breaking the seal. Additionally, action against the unauthorized construction shall also be taken in accordance with law.

He further submits that Demolition Order qua the property in question has been issued on 24th July, 2024 and 19th September, 2024. 6.

At this stage, learned counsel appearing for the petitioner submits that the electricity connection in the property still exists and requisite direction should be given to the BSES Rajdhani Power Ltd. for disconnecting the electricity connection.

Responding to the aforesaid, learned counsel appearing for the BSES Rajdhani Power Ltd., submits that whenever any intimation is received with respect to disconnection of electricity, the said action will be taken. 8.

He submits that he shall verify the fact as to whether the electricity connection in the property in question has been disconnected and whether the connection, which still exists in the property, is authorized. 9.

Having heard learned counsels appearing for the parties, the concerned officials of the MCD and Station House Officer ("SHO"), Police Station Mehrauli, are directed to ensure that no further unauthorized construction takes place in the property in question. Further, the respondent no. 5 shall ensure that since the sealing and demolition action is being taken by the MCD in the property in question, the electricity connection of the said property is duly disconnected, if already not done so.

The MCD, along with local police, is bound to take requisite action against the unauthorized construction existing in the property and to ensure that no further unauthorized construction takes place. 12.

In case, the petitioner is aggrieved by any non-action on the part of the MCD, the petitioner shall have liberty to seek remedies in accordance with law.
