% 12.03.2018 Learned counsel for the appellant states that appeal has become infructuous as the period of 90 days referred to in the order dated 4th December, 2017 has expired. He, however, states that the order is yet not been executed. He submits that in case extension of time is granted by the Single Judge, he may ask for the revival of the appeal. Recording the above statement, the appeal is dismissed as infructuous, with liberty to the appellant to ask for revival of the appeal, if required and necessary. We have not commented on merits.
