The present petition has been filed under Section 482 CrPC seeking quashing of FIR No.41/2018 under Sections 354/354B/452/427/323/34 IPC registered at Police Station Sultan Puri and all consequential proceedings emanating therefrom on the ground that the parties have arrived at a settlement.

Issue notice. The learned APP for the State accepts notice. He submits that since the FIR is an outcome of a matrimonial dispute and the parties have arrived at a settlement, the State has no objection in case the FIR in question is quashed.

The present FIR has been registered at the instance of respondent no.2, sister of Maninder Singh, who is husband of Kiran Kaur. 5.
The FIR is an off-shoot of a matrimonial dispute between Maninder Singh and his wife namely Kiran Kaur.

The case in brief is that the marriage between Maninder Singh and Kiran Kaur was solemnized on 26.02.2017 according to Hindu Rites and Customs. On account of temperamental issues certain disputes arose between the parties. The dispute between the parties also led to the registration of the present FIR as well as two more cross FIRs. 7.
During the pendency of the proceedings, the parties have arrived at a settlement, terms whereof were reduced in writing in the form of Memorandum of Understanding dated 07.12.2023, which is annexed as Annexure P-3 to the present petition.

It is recorded in the settlement that the parties have amicably resolved all their disputes and now the wife namely Kiran Kaur is residing in her matrimonial home along with her husband Maninder Singh. 9.
The respondent no.2, on a query put by the Court, states that she has no objection in case the FIR is quashed.

In view of the settlement between the parties, the ultimate chances of conviction in the case are bleak, therefore, continuation of criminal proceedings will not serve any useful purpose and it will be an exercise in futility.

It is, thus, in the interest of justice that the present FIR and all other proceedings emanating therefrom be quashed.

Consequently, the petition is allowed and the FIR No. 41/2018 under Sections 354/354B/452/427/323/34 IPC registered at Police Station Sultan Puri alongwith all other proceedings emanating therefrom, is quashed. 14.
The petition stands disposed of in the above terms. 15.
