By this petition the petitioner seeks modification of the order dated 28th October, 2017 whereby he has been granted first spell of furlough for a period of three weeks subject to his furnishing two surety bonds for a sum of ₹10,000/- each and a personal bond in the like amount. Learned counsel for the petitioner states that in view of the penury condition of the petitioner, he is not in a position to furnish two surety bonds. A Status Report has been handed over in response to the petition as per which the permanent address of the surety Bhuvali Singh has been verified. Further, the brother of the petitioner Bharat Singh who earlier stood surety is also residing peacefully in the village. W.P.(CRL) 906/2018
Considering the fact that the petitioner has roots in the society, the order dated 28th October, 2017 is modified and it is directed that the petitioner be now released on his furnishing a personal bond in the sum of ₹10,000/- with one surety bond in the like amount subject to the satisfaction of the Superintendent, Central Jail No.3, Tihar. Rest of the conditions in the order dated 28th October, 2017 granting furlough for a period of three weeks will remain the same.
Petition is disposed of.
Copy of this order be communicated to the petitioner through Superintendent, Tihar Jail.
