O R D E R

% 03.04.2018 By this petition, the petitioner challenges the communication dated 12th January, 2018 declining to grant parole to the petitioner on the ground that there was no compelling/emergent requirement, an apprehension that there may be an adverse impact on the victim party and the convict may jump the parole.

On a notice being issued a status report has been handed over which is taken on record. As per the status report the father of the petitioner was under treatment at Hoshiyar Singh Memorial Multi Speciality Hospital, Kharkhoda, Haryana on 13th March, 2018. The father of the petitioner has since been referred to G.B. Pant Hospital from Hindu Rao Hospital. As per the nominal roll the petitioner was granted parole by this Court W.P.(CRL) 679/2018

w.e.f. 22nd February, 2017 which was extended upto 12th May 2017 by this Court and there is no allegation that during the period of parole the petitioner misused the concession granted to him. Further the last jail punishment awarded to the petitioner related back to 23rd March, 2016. Considering that more than one year has lapsed from the last jail punishment and the facts stated in the application have been verified this Court deems it fit to grant parole to the petitioner. It is therefore directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹25,000/- with one surety of the like amount, to the satisfaction of learned Trial Court/CMM concerned.

Petition is disposed of.

Copy of this order be communicated to the petitioner through Superintendent, Mandoli Jail.
