% 15.03.2017 The status report has been filed. The nominal roll dated 04.03.2017 has also been brought on record. The same have been perused. Ms. Rao submits that the ground taken by the petitioner with regard to the shifting of the minor child of the petitioner from a private to a government school is found to be genuine.

The petitioner is seeking parole for the aforesaid purpose as also on the ground that he has to receive medical treatment. The nominal roll shows that the petitioner has been on furlough in three spells in the year 2016, the last being between 19.10.2016 and 02.11.2016 for a period of two weeks. He is undergoing a life sentence in case FIR 569/2000 u/s 364A/34 IPC

registered at PS Preet Vihar.

Learned counsel for the petitioner submits that the petitioner's jail conduct has been found to be satisfactory. He has not availed of any parole in the year 2016.

Considering the fact that the petitioner has availed of furlough on three occasions in 2016 including as late as between 19.10.2016 and 02.11.2016, and the fact that six months period has not elapsed since then, coupled with the fact there is need for the petitioner to be out of prison so that he could attend to his child's admission process, the petitioner is directed to be released on parole for a period of three weeks subject to: i) his furnishing personal bond with one surety in the sum of Rs10,000/- to the satisfaction of the Jail Superintendent; ii) he shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent;

iii) he shall report at the local police station to mark his attendance on every Monday at 11:00 a.m. during the period of parole; iv) he shall duly surrender at the end of the period of parole; and v) he shall also not indulge in any criminal activity while on parole. A copy of this order be communicated to the Jail Superintendent. Dasti.
