% 25.04.2016 This matter has been listed on the basis of the office note dated April 23, 2016, wherein a reference has been made to the order passed by the Additional District Judge-4, North-West, Rohini Courts dated April 2, 2016. The same reads as under:- "One application u/s. 24 CPC has been filed by the plaintiff seeking transfer of this case file. The application filed by the plaintiff is not maintainable as per law, hence, the application is dismissed. The plaintiff is at liberty to move an appropriate application before the appropriate forum. At this stage, it is submitted by the plaintiff that the suit property is falling within the jurisdiction of PS Roop Nagar. It is further stated that the defendants are also residing within the
jurisdiction of Central District. It is prayed therefore, that the matter may be transferred to the concerned district i.e Central District.
Consider the directions given by the Hon'ble High Court of Delhi vide notice/circular ref. No.1/TC/ORG/DHC dated 29.03.2016, let the file be placed before the Hon'ble High Court of Delhi for necessary orders.
It is reflected that the suit property in question is lying within the jurisdiction of Central District i.e PS Roop Nagar and three parties out of the four defendants are also residing at Kamla Nagar which also falls within the jurisdiction of Central District.
Parties are directed to appear before the Hon'ble High Court of Delhi on 25.04.2016.
Ahlmad is directed to send the file, complete in all respects to the Hon'ble High Court of Delhi well in advance, as per the above-mentioned circular."
In view of the aforesaid order, the matter is transferred to the court of learned District & Sessions Judge, Central District, Tis Hazari Courts.
