% 24.08.2017 Crl.M.(Bail) 1451/2017 (interim bail) in Bail Appln.345/2017 The petitioner seeks interim bail for the purposes of looking after his mother who has been diagnosed with a tumor in ovary which is required to be removed urgently.
The status report, however, states otherwise. After verification, it has been found that the mother of the petitioner is not having any tumor in the ovary. For the ailment with which the mother of the petitioner is suffering, surgery may be required but that shall be only an elective surgery which could be done at any time. The report further reveals that there is no urgency for the petitioner to come out of jail as an interim measure to look after his mother. The medical report further indicates that an attempt could be made for non-surgical treatment to the mother if she is willing.
Considering the aforesaid aspects, the prayer for interim bail is rejected.
The application is disposed of.
Bail Appln.345/2017 After some arguments, learned counsel for the petitioner seeks permission to withdraw the bail application.
Dismissed as withdrawn.
