This application has been moved by applicant/Mr. Sukhinder Bir Singh whereby he seeks his impleadment in the present petition. He submits that he is already a party to the appeal in question, which fact has not been disputed by learned counsel for the petitioner as well as by learned Standing Counsel for MCD.

The status report has also been received from the learned Appellate Tribunal, MCD and, as per the abovesaid report also, such application moved

by intervener Mr. Sukhinder Bir Singh under Order I Rule 10 CPC was disposed of on 01.10.2024.

In view of above, the abovesaid application is allowed and Mr. Sukhinder Bir Singh is impleaded as party to the present petition. 4.

Let amended memo of parties be filed accordingly. 5.

The grievance raised in the present petition is a very short one. 6.

Admittedly, the petitioner herein has already filed one appeal before the learned Appellate Tribunal, MCD which is registered as Appeal No.819/2024. Learned Tribunal heard arguments in part on the interim application and fixed up the matter for further arguments on 01.10.2024. 7.

Since there was no interim relief, the appellant filed an appeal before the Court of learned Principal District & Sessions Judge, North-West District, Delhi and his such appeal was also dismissed on 09.10.2024, holding that he was not entitled to any such relief.

Such order is under challenge.

When the present petition was taken up by this Court on 21.10.2024, it was informed that the property in question was lying sealed, except for the first and second floors and this Court direction that the status quo, to the abovesaid effect, be maintained.

The next date before learned Appellate Tribunal, MCD is stated to be 24.09.2025.

Instead of going into deeper evaluation of the present matter, it would be appropriate to dispose of the appeal by requesting learned Presiding Officer, Appellate Tribunal, MCD to take up the abovesaid appeal on the date fixed i.e. 24.09.2025 and to make best endeavour to dispose of such appeal as expeditiously as possible, preferably within a period of eight weeks from that

date i.e. 24.09.2025.

Ordered accordingly.

Needless to state, both the sides would render their best cooperation and assistance to learned Appellate Tribunal, MCD so as to achieve expeditious disposal of appeal.

The status quo in terms of order dated 21.10.2024 be maintained till 24.09.2025 and, thereafter, as per further directions to be passed by learned Appellate Tribunal, MCD.

Present petition stands disposed of in aforesaid terms. 16.
