The instant petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 (earlier under Section 482 of the Code of Criminal Procedure, 1973) has been filed on behalf of the petitioners seeking quashing of FIR No. 316/2015 registered at Police Station - Prasad Nagar, under Sections 498A/406/34 of the Indian Penal Code, 1860. 2.

This Court has earlier passed an order dated 21st October, 2024, wherein the parties herein were referred to the Delhi High Court Mediation & Conciliation Centre to explore the possibility of an amicable settlement with respect to the rights and interests of the male child born of the wedlock between the petitioner No.1 and the respondent. Upon perusal of the report of the Mediation Centre, it is observed that the matter is "not settled" between the parties. 4.

On query of this Court, the complainant, who is present in-person, submitted that she does not agree with the terms and conditions of the settlement deed dated 30th May, 2024, especially with respect to the condition which refrains the child of any maintenance. 5.

In light of the respondent no. 2's disagreement to the terms and conditions of the settlement deed dated 30th May, 2024, this Court does not find any merit in the instant petition seeking quashing of the instant FIR on the premise of settlement, as there is no settlement in existence. 6.

Accordingly, the instant petition is dismissed.
