Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of the petitioner for setting aside summoning order dated 14.08.2024 passed by learned JMFC-02, Saket Courts, New Delhi in Complaint Case No.465821/2016, whereby the petitioner has been summoned under Sections 420/120B IPC. 2.

At this stage, learned counsel for the petitioner seeks to withdraw the petition with liberty to file a Revision Petition before the learned Sessions Court challenging the impugned order dated 14.08.2024 without prejudice to the rights and contentions of the petitioner. 3.

petition is accordingly disposed of with liberty to the petitioner to approach the learned Sessions Court in the first instance, as prayed. In the meantime, NBWs issued against the petitioner vide order dated 05.10.2024 by the learned Trial Court, shall remain stayed for a period of four weeks, to enable the petitioner to file the Revision Petition as prayed. A copy of this order be forwarded to the learned Trial Court for information.
