CRL.M.C. 8280/2024 1.
This petition has been filed seeking quashing of the FIR No.8/2018 PS K.M. Pur, under Sections 308/326/452/34 IPC on the basis of a settlement arrived at between the parties. The respondents No.2-5/complainants are present through VC, duly identified by IO and state that they have no objection to the quashing of the FIR, considering that they have settled the matter out of Court with the petitioner.
2.
APP for the State, however, raises an objection to the same considering that the charges involved were under Section 308/326 IPC as well and there were injuries suffered by the some of the respondents. 3.
However, the complainants state that they have duly been compensated The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. The Order is downloaded from the DHC Server on 02/07/2025 at 09:01:22
and don't want to pursue the said FIR any further. 4.
Petitioner is present in the court and is duly identified by IO. The petitioner will deposit a cost of Rs.10,000/- to New Delhi Bar Association Members Welfare Fund Account within a period of two weeks. The affidavit of compliance shall be placed on record within two weeks thereafter. 5.
Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No. 8/2018 under Sections 308/326/452/34 registered at PS K.M. Pur and proceedings emanating therefrom are quashed.
6.
Parties shall abide by the terms of settlement. 7.
Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
