Present suit has been filed by the Plaintiffs seeking permanent and mandatory injunction restraining the Defendants from infringing and passing of with respect to registered trademark 'ANANTARA' as also for rendition of accounts, damages, delivery up, etc. By order dated 21.10.2024, Court had granted ex parte ad interim injunction order in favour of the Plaintiffs. 2.

Learned counsel for the Defendants, on instructions, submits that Defendants have discontinued the use of trademark 'ANANTARA' and undertake before this Court that they will not use the mark in future. 3.

Learned counsel for the Plaintiffs, on instructions, states that since the Defendants are willing to suffer injunction, they will not press for damages, costs and other reliefs and the interlocutory injunction be made absolute. Accordingly, a decree of permanent injunction is passed in favour of the Plaintiffs and against the Defendants restraining Defendants, their Directors, Promoters, Franchisees, Associates, Licensees, Agents, Successors, Assigns, Members, Employees, and other persons or entities claiming through them from infringing wordmark ANANTARA and/or its formatives and passing off their goods and services as and for the goods and services of the Plaintiffs by use of the said mark or any other mark deceptively or confusingly similar to Plaintiffs' ANANTARA Trademarks or Mangalam ANANTARA/Mangalams ANANTARA/Mangalam Anantara the Villas or any ANANTARA trademark and/or as a part of their corporate name and/or as their trading style, or in any other manner whatsoever. 5.

It is, however, clarified that Defendants will be at liberty to carry out their business by using the mark 'Mangalam' or 'Mangalamhome', or any other mark which is not similar or deceptively similar to Plaintiffs' trademark ANANTARA and/or its formatives.
