% 14.01.2016 This is a suit for specific performance. The suit is valued at Rs. 1,28,00,000/-.
In view of Notification No. 27187/DHC/Orgl. dated 24th November, 2015 & in exercise of power conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015, (Act 23 of 2015), which came into force with effect from 26th October, 2015 vide Notification No. F.No.L19015/04/2012-Jus dated 26th October, 2015 issued by the Government of India, Ministry of Law, Justice & Company Affairs published in Gazette of India Extraordinary, Part II, Section 3 Sub-Section (ii), the present matter is liable to be transferred to the learned District & Sessions Judge (North West), Rohini Courts. Accordingly, the parties to appear before the learned District & Sessions Judge (North West), Rohini Courts on March 14, 2016. Mr.Dinesh Agnani states, since this Court is transferring the suit to
the District Court, the order appointing the Local Commissioner for recording the evidence be vacated.
I note, that a local commissioner was appointed vide order dated February 13, 2015 for recording the evidence. Since the matter is now being transferred to the District Court, the concerned Judge would record the evidence himself. The order dated February 13, 2015 appointing the local commissioner is vacated.
