The counsel for the respondent no.1 has drawn attention to the order dated 8th February, 2017 directing the petitioner to file affidavit and states that inspite of repeated opportunities, the said affidavit also has not been filed.

On enquiry, the counsel for the respondent no.1 states that the petitioner is still in possession of the premises, allotment whereof in favour of the petitioner was cancelled and wherefrom the petitioner has been ordered to be evicted.

Dismissed in default.

It is expected that the respondents no.1&2 will now not delay eviction of the petitioner from the premises.
