The present petition under Article 226/227 of the Constitution of India seeks the following prayers:

"a) Set aside Set aside notice dated 10.07.2024 bearing Reference No. DS/NHP/1721218/000/Enf null/Damages passed by the Regional Provident Fund Commissioner II, Delhi b) Quash the order dated 03.03.2023 issued on 15.03.2023 (received by the Petitioner on 20.03.2023) and 28.06.2024 issued on 10.07.2024 (received by the Petitioner on 12.07.2024) passed by the Ld. regional provident fund commissioner demanding the damages;

c) Call for the records of the case;

Learned counsel for the petitioner submits that the appeal of the petitioner before the learned Appellate Tribunal is now fixed for hearing on 25.09.2025 along with the application seeking stay of the impugned notice dated 10.07.2024.

Learned counsel for the respondent confirms the aforesaid position. 5.

In view of the above, the present petition is disposed of with directions to the learned Appellate Tribunal to dispose of the application seeking stay by the petitioner on the date fixed, in accordance with law. 6.

The interim order dated 21.10.2024 passed by the learned Predecessor Bench of this Court shall continue to operate till the date fixed before the learned Appellate Tribunal and on that day the application seeking stay shall be determined by the learned Appellate Tribunal. 7.

The contentions of both the parties have not been adjudicated upon and the same are kept open before the learned Appellate Tribunal. 8.

Order be communicated to learned Appellate Tribunal for necessary information and compliance.
