W.P.(CRL) 3271/2024 1.
This petition has been filed seeking quashing of the FIR No.1122/2021 at PS Mangol Puri, under Sections 288/337 IPC basis settlement arrived at between the parties dated 20th August, 2024.
2.
As per the settlement, both the complainants are being paid the balance amount of Rs.15,000/- each today by cheque nos. 000018 and 000019 dated 21st October, 2024, drawn on Punjab and Sind Bank. The same has been handed over to respondent no.2 and respondent no.3 who are present in Court and are duly identified by IO and the respective counsel. 3.
Petitioner nos. 1 and 2 are also present in Court and are duly identified by IO and the respective counsels.
4.
Respondent No.2 & 3 state that they have no objection to the quashing of the FIR subject to cheques being honoured. 5.
Considering the above settlement between the parties and the chances of conviction of the petitioners being remote and bleak, there is no use continuing with proceedings of the present FIR as it would be a misuse of the process of the Court and an unnecessary burden on the State exchequer. Accordingly, the petition is allowed. Consequently, the FIR No. 1122/2021 under Sections 288/337 IPC registered at PS Mangol Puri and proceedings emanating therefrom are quashed subject to the cheques being honoured. 6.
The respondent No. 2 & 3 are at liberty to inform this Court through the IO that in case the cheques are not honoured in the matter. 7.
Parties shall abide by the terms of settlement. 8.
Accordingly, the petition is disposed of. Pending applications (if any) are disposed of as infructuous.
