The present petition under Article 226 of the Constitution of India read with Section 528 of BNSS, 2023 has been filed on behalf of the PetitionerMs. Ravina Khatun seeking issuance of a writ of Habeas Corpus for production of her minor girl namely 'S'.

On the last date of hearing Mr. Sanjay Lao, ld. Standing Counsel for the State had submitted that some initial investigation had been carried out and efforts were being made to produce the girl. 4.
Today, a status report dated 4th November, 2024 has been handed over by Mr. Sanjay Lao, Standing Counsel for the State and the same has been taken on record. along with the alleged person- Rajesh was traced near the New Delhi railway station. The girl has been produced today. The mother has also appeared before the Court. The Court has interacted with them in the chamber. The girl is not yet a major. But she confirms that she has voluntarily and willingly left with the boy called Rajesh and had, in fact, got married to him in Mandir. 5.
The girl has interacted with the mother and states that she does not wish to accompany her mother. She states that she does not wish to go back to her parental home. Accordingly, let the girl be produced and placed before Nirmal Chhaya where she would be provided facility of education, if she wishes to avail the same. Considering the nature of the matter and the allegations in this case, periodic counselling be also provided to the girl. 6.
The ld. Trial Court, where the case against Rajesh has been registered in FIR No.628/2024 under Section 137(2) of the Bharatiya Nyaya Sanhita ('BNS'), shall also interact with the girl from time to time. The girl shall also be periodically produced before the CWC to monitor her well-being. 7.
The present order be placed before the ld. Trial Court, and the CWC shall supervise the well-being of the girl.

The petition is disposed of in the above terms. 9.
