This petition has been filed seeking furlough in FIR No.226/2010 registered at P.S. Burari under Sections 302/498-A/34 IPC. As per the Nominal Roll, the petitioner has been in custody for about 16 years, including remission.

As regards the previous involvement in FIR No. 375/2022, under the Gambling Act registered at P.S. Soniya Vihar, he was convicted but admonished for the offence. Since he had not disclosed his involvement in this offence, the Police Verification Report during the SRB proceedings revealed the same. The furlough has been, therefore, rejected by order dated 5th October, 2024 on this account, noting his unsatisfactory conduct. It is noted that petitioner has been granted furloughs/parole 28 times, from 2013 onwards and otherwise has not misused his liberty. 4.

At this time, the furlough has been sought on account of the medical condition of the mother, who is suffering from Stage-IV Oral Cancer and is 69 years of age. Medical documents have been appended, which have been verified by State from the Delhi State Cancer Institute, Metro Hospital & Cancer Institute.

In view of the above, this Court sees no impediment in granting furlough to the petitioner. The petitioner is enlarged on furlough for a period of 2 weeks from the date of release subject to furnishing a personal bond in the sum of Rs. 10,000/- (Rupees Ten Thousand only) with one surety of the like amount to the satisfaction of the Jail Superintendent subject to the following conditions:- i. During the period the petitioner remains out on furlough, the petitioner shall report to the SHO, Police Station- Burari, Delhi on every Saturday.

ii. The petitioner shall also provide the SHO, Police Burari, Delhi with a mobile telephone number which shall be kept in working condition at all times and shall not switch off or change the mobile number without prior intimation to the SHO concerned. iii. The petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the complainant/victim or any member of the complainant/victim's family or tamper with the evidence of the case. iv.
