Petition under Section 528 of Bhartiya Nagrik Suraksha Sanhita, 2023 has been filed by the Petitioner seeking quashing of FIR No. 0746/2016 registered under Sections 498A/406/34 IPC at P.S. Subhash Place, Delhi and all the proceedings emanating therefrom in terms of the Compromise Deed dated 19.06.2017.

It is submitted that marriage of Petitioner No.1-husband with Respondent No.2-wife was solemnized on 19.12.2009 as per Hindu Rites and Customs and out of their wedlock, one child was born. However, due to temperamental differences, Respondent No. 2 and the Petitioner No. 1 started living separately.

It is stated that on 31.12.2016, the basis of complaint filed by the Respondent No. 2, FIR No. 0746/2016 was registered under Sections The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

The parties are present in person in the Court and have been identified by their respective Counsel and the Investigating Officer. 5.

It is submitted that with the intervention of family members, relatives and well wishers, Petitioner and Respondent No.2 have resolved their disputes and arrived at an amicable settlement, terms whereof have been recorded in Compromise Deed dated 19.06.2017 and since then, they are residing together without any acrimony.

It is submitted by the parties that they have arrived at a settlement without any force, coercion and undue influence and pressure and they have signed the Compromise Deed dated 19.06.2017 voluntarily with their wish and will.

Learned Counsel for Petitioner submits that the parties have been happily living together since 19.06.2017 and no grievance against each other survives and since Respondent No.2 has already made a statement before the Court that she does not want to pursue the proceedings in FIR No.0746/2016, the present Petition be allowed and FIR registered against the Petitioner, be quashed.

Respondent No.2 is present and submits that she has no grievance against the Petitioners and also no objection to the quashing of FIR. She affirms that she is happily living together with Petitioner. 9.

In view of the fact that the FIR in question was premised upon a matrimonial dispute between Petitioner and Respondent No.2, which has been amicably resolved in term of Compromise Deed dated 19.06.2017 and the fact that parties have been living together for last 08 years and also that Respondent No.2 has given no objection to the quashing of FIR, no fruitful The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
