This is a writ petition filed under Article 226 of the Constitution of India seeking the following prayers:- "a) Issue the writ of mandamus or an appropriate writ, directing the Respondents to immediately update the school records and correct details of Petitioner's daughter therein; b) Allow Petitioner's daughter admission in GBSSS, Nangloi, Sultanpuri Road, A - 74 , Gali No. 01 Friend Enklev Sultan Puri, Delhi - 110086 in any class for which she is eligible; . . ."

The case of the petitioner is that the petitioner's daughter, "E" (wrongly mentioned as "I") was studying upto 5th standard at MCD Girls School, JJ Colony No.2, Nangloi, Delhi-110041 i.e. the respondent No.4. When the petitioner (mother of the child) went to admit the child i.e. "E" in 6th standard in another school, she came to know about the fact that her parentage had been wrongly mentioned in the respondent No.4 school.

The maternal grandmother of the minor child had registered herself as the guardian of daughter "E" and the petitioner was unaware of the same.

In the year 2021, the petitioner approached the respondent No.3 disclosing that she is the biological mother of the child "E" and having obtained divorced from her husband, the record of the respondent No.3 needs to be corrected.

Subsequently, an FIR No. 152/2021 was registered under POCSO Act, 2012 against a close relative of the petitioner for committing offences against "E". Since the accused and his family members were residing in the vicinity of the respondent No.4's school, the petitioner stopped sending her daughter to the school and consequently the child's name was struck off from the school roll.

As the respondent No.4 school is refusing to change the details of the petitioner's daughter, the present petition has been filed. 8.

Mr. Sannu, learned standing counsel appears on behalf of the respondent Nos. 1 to 3.

Mr. Nath, learned standing counsel, who was present in Court, has been requested to appear on behalf of the respondent No. 4.

Since there is no dispute that the petitioner is the natural guardian and mother of the minor child "E", it is directed that the respondent No. 4 school shall update the record of the child "E" and show the name of The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

the petitioner as the mother and natural guardian within 1 week from today and forward the same to the respondent Nos. 1 and 2 for updating their own records.

11. Additionally, the petitioner is desirous of continuing the education of child "E" in National Institute of Open Schooling ("NIOS").

12. Keeping in view the difficult circumstances, the NIOS is directed to provide assistance and ensure there is no impediment or gap in the academic career of the child "E".

13. The respondent No. 4 shall also ensure grant of Transfer Certificate ("TC") with correct updation within 2 weeks from today.

14. The timelines shall be followed scrupulously.

15. The petition is disposed of in the aforesaid terms.
