This petition was scheduled to be listed on 28.05.2026, but has been listed today, as 28.05.2026 was declared a holiday vide Notification No. 77/I-G-4/Genl.-I/DHC dated 26.05.2026.

By an order dated 22.05.2026, it was recorded as follows: "1. By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioners seek quashing of FIR No. 161/2021 dated 25.03.2021, registered at Police Station Govind Puri, New Delhi, under Sections 498A/406/34 of the Indian Penal Code, 1860, on merits.

2. Mr. Varinder Kumar Sharma, learned counsel for the petitioner, states that in the meantime, the parties have entered into a Settlement Agreement dated 24.03.2026, whereby they have amicably resolved their disputes and have, inter alia, agreed that the subject FIR be quashed.

application in this regard, duly supported by affidavits of the complainant as well as the accused persons."

Although copy of a settlement deed dated 24.03.2026 has been filed in Court, no joint application has been filed yet. Further, respondent No. 2, who appears on video conference, submits that the first motion in the divorce proceedings has already taken place, but the second motion is yet to take place, and the settlement amount is to be paid to her only at the time of the second motion.

This petition, as filed, seeks quashing of the FIR on merits, and there is neither a joint application, nor an affidavit of respondent No. 2, signifying no-objection to the quashing. The settlement is also only partially implemented, as the second motion in divorce proceedings, remains awaited. At this stage, therefore, the relief on the ground of settlement is pre-mature.

In view thereof, this petition is disposed of, with liberty to the petitioner to approach the Court afresh on the basis of compromise, at the appropriate stage.
