Transfer, invoking Section 24 of the CPC, is sought of Divorce Petition bearing No.461/2014 from the Court of Principal Judge, Family Court, Dwarka Courts, New Delhi to the Court of Ms.Pinki, Principal Judge, Family Court, Rohini Courts, New Delhi where some other cases initiated by the petitioner/wife against the respondent/husband are stated to be pending.

The notice of the petition was ordered to be issued and is reported to be served and the counsel for the respondent appears. 3.

The counsel for the respondent states that there was a settlement and that the petitioner/wife had agreed to divorce but has now not backed out from the same. It is also stated that the respondent/husband is residing in the jurisdiction of the Dwarka Courts.

The petitioner/wife is residing in the jurisdiction of the Rohini Courts. TR.P.(C.) 38/2017

Since some proceedings are admittedly pending in the Rohini Court, it is deemed appropriate to allow the petition.

The petition is allowed. The proceedings aforesaid are ordered to be transferred as sought.

The Transferor Court is requested to forthwith physically transfer the file.
