The present writ petition has been filed seeking directions to the respondent nos.1 to 5, to take action against the unauthorized construction in House No. E 58, Village Hiranki, Main Chowk, Delhi-110036, being carried out by the respondent no. 6.

Status report has been handed over on behalf of the respondent/MCD in Court and the same is taken on record.

As per the status report, the subject property has been booked on 17th October, 2025 and demolition order has been passed on 11th November, 2025.

Counsel appearing on behalf of the private party/ respondent no.6 has handed over an order dated 6th December, 2025 passed in W.P.(C) 18574/2025, which was filed by the respondent no.6 herein. 5.

The said writ petition was filed by the respondent no.6 against the demolition order dated 11th November, 2025 passed by the respondent/MCD in respect of the same property which is the subject matter of the present petition.

The said writ petition was disposed of after taking note of the submission of the petitioner therein that an appeal has been filed before the Appellate Tribunal MCD (hereinafter referred to as 'ATMCD'). The said petition was disposed of on 6th December, 2025 directing that MCD shall not take action against the petitioner therein (respondent no.6 herein) till the The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

next date of hearing before ATMCD, i.e., 12th February, 2026. Further, a direction was issued to the petitioner not to carry out any unauthorized construction in the said property.

Copy of the said order has been handed over in Court and is taken on record.

Accordingly, MCD shall take action in respect of the subject property based on the outcome of the decision of the ATMCD. 8.

It is further stated on behalf of respondent no.6 that an application for regularization of construction has been filed by the respondent no.6 and is under process as per rules.

8.1.

Needless to state, the aforesaid application shall be considered by MCD in accordance with the rules.

Considering the aforesaid submissions, both the writ petitions stand disposed of.
