Petitioner before this Court is Shalimar Bagh Residents Welfare Association. Their contention is that weekly Thursday Bazar which is being held at AH Block Road, Shalimar Bagh adjoining Prabu Dayal Public School be directed to be removed as this causes a lot of harassment to the residents of the locality. This weekly bazar is unauthorised and illegal.
Counter affidavit has been filed by the respondent. The stand of the respondent/North Delhi Municipal Corporation is that the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 has been promulgated and Section 3(3) of the
said Act gives protection to both legal and illegal street vendors. Contention is that the grievance of the petitioner, if any, cannot be answered by the respondent in view of the aforenoted protection as also the subsequent judgment of the Division Bench of this Court in Bhola Ram Patel Vs. NDMC & Ors. LPA No.136/2016 decided on 18.5.2016.

Since none has appeared for the petitioner. This petition is dismissed in default as also on merits.
