This is a petition under Section 528 BNSS filed on behalf of the petitioner seeking quashing of FIR no. 42/2025 under Sections 78/79 BNS, PS Cyber Police Station, South-West.

At the very outset, Ld. APP has objected to the maintainability of the petition submitting that the FIR has been registered on 28.06.2025 and investigation has just started. The matter is being investigated and there is possibility that many more persons might be the victims. 3.

At this stage, Mr. Rajesh Mishra, Ld. Counsel appearing for the petitioner states that he does not want to press the present petition at this stage and seeks permissions to withdraw the same with liberty to file a fresh petition at an appropriate stage.
