By way of this bail application, the applicant seeks anticipatory bail in connection with e-FIR No. 014411/2025, dated 24.05.2025, registered under Section 305(b) of the Bharatiya Nyaya Sanhita, 2023 ["BNS"], at Police Station Prashant Vihar.

I have heard Mr. Prateek Singh Kundu, learned counsel for the applicant, and Ms. Manjeet Arya, learned Additional Public Prosecutor. Alongwith the status report dated 04.11.2025, the Investigating Officer has placed on record an intimation sent to the victim/complainant regarding the pendency of this petition before this Court. The intimation appears to bear the signature of the complainant; however, he has not appeared in the proceedings.

The e-FIR has been registered at the instance of the complainant in connection with the alleged theft of his car, namely, Mahindra Thar, The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

At the time of registration of the FIR, the identity of the accused was not known. Subsequently, the jurisdictional police station was informed by the officer investigating another vehicle theft at Police Station Raj Park that, the vehicle, which is the subject of the present FIR, had been recovered from the applicant herein in the course of investigating a separate FIR [e-FIR No. 21029/2025 dated 01.08.2025 registered at Police Station Raj Park under Section 305(b) of the BNS]. 5.

The applicant was granted interim protection by order of this Court dated 13.11.2025, subject to his joining the investigation. 6.

Ms. Arya, on instructions from the Investigating Officer, states that the applicant has joined the investigation and that the investigation has since been completed. She further submits that a charge-sheet has been filed without arrest of the applicant, in view of the interim protection granted by this Court.

In view of the above, and considering that the vehicle has already been recovered, there is no necessity for custodial interrogation of the applicant at this stage.

The petition is, accordingly, allowed, and it is directed that in the event of the applicant's arrest in connection with e-FIR No. 014411/2025 dated 24.05.2025, registered at Police Station Prashant Vihar, under Section 305(b) of the BNS, he shall be released on bail, subject to furnishing a personal bond in the sum of Rs. 50,000/-, and a local surety of the like amount, to the satisfaction of the concerned Investigating Officer/Station House Officer, and subject to compliance with the following further conditions:

a) The applicant shall appear before the Trial Court on every date of hearing.

b) The applicant shall provide his mobile number to the Investigating Officer and shall ensure that his mobile phone remains switched on and in proper working condition at all times. The mobile number shall not be changed or the phone switched off without prior intimation to the Investigating Officer.

c) The applicant shall furnish his current residential address to the Investigating Officer and shall not change his address without prior intimation to the Investigating Officer.

d) The applicant shall not, directly or indirectly, contact the complainant or any witness or potential witness, nor shall he tamper with, influence, or attempt to interfere with any evidence. e) The applicant shall not leave the country without permission of the concerned Trial Court.

The application stands disposed of in these terms. 10.

It is clarified that the observations made herein are confined to the adjudication of the present bail application and shall not be construed as an expression of opinion on the merits of the case, nor shall they prejudice the rights of any party in the proceedings.
