The present writ petition has been filed seeking directions to protect the rights of the petitioners by ensuring continuation of the interim stay order granted earlier by the Appellate Tribunal Municipal Corporation of Delhi ("ATMCD"), vide order dated 12th December, 2024 and extended vide orders dated 31st January, 2025, 07th April, 2025 and 23rd July, 2025, in the appeal bearing No. 442/2024 before the ATMCD. 2.
It is submitted that the petitioners are the Legal Representatives ("LRs") of Late Shri I. M. Chawla, who was the sole and absolute owner of entire second floor with roof rights of the property bearing No. 24/70 Punjabi Bagh West, New Delhi-110026.

Learned counsel for the petitioners submits that the petitioners have preferred an appeal bearing No. 442/2024 before the ATMCD against the communication dated 13th October, 2023, passed by the respondentMunicipal Corporation of Delhi ("MCD"). 4.

the petitioners vide orders dated 12th December, 2024, which was subsequently extended vide order dated 31st January, 2025, 07th April, 2025 and 23rd July, 2025.

It is further submitted that the operation of the stay exists till today, i.e., 23rd September, 2025.

It is submitted that since there is no Presiding Officer in the ATMCD, therefore, the matters are not being heard.

Thus, the present petition has been filed.

Issue notice. Notice is accepted by learned counsel for respondentMCD. 9.
Having heard learned counsels for the parties, it is directed that the interim stay, as granted by the ATMCD vide order dated 12th December, 2024, and as continued vide orders dated 31st January, 2025, 07th April, 2025 and 23rd July, 2025, shall continue till the next date of hearing before the ATMCD.

It is further clarified that, in case, on the next date given by the ATMCD, there is still no Presiding Officer, the protection shall automatically extend to any further date that is granted before the ATMCD. 11.
With the aforesaid directions, the present writ petition, along with pending application, is accordingly disposed of.
