The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.325/2013 registered under Sections 498A/406 IPC at PS Nihal Vihar. Status report is on record.

I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. By an order dated 01.05.2014, the petitioner was granted interim protection and was directed to join the investigation as and when required. He was further directed to pay `3,000/- per month to the complainant - wife w.e.f. January, 2014.

Undisputedly, the petitioner has joined the investigation since then.

`6,000/- (in cash) have been given to the complainant towards arrears. It is informed that remaining amount of `12,000/- shall be paid to the complainant within two weeks through the Investigating Officer.

During the course of arguments, petitioner's counsel, on instructions, volunteered to pay `2 lacs to the complainant without prejudice and subject to future adjustment (if any). On this, the complainant has no objection to the grant of anticipatory bail. 4.

Considering the facts and circumstances of the case and the petitioner's offer to pay `2 lacs to the complainant without prejudice and subject to future adjustment, the petitioner is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall, however, join the investigation as and when required.

He shall pay `2 lacs to complainant within two weeks through Investigating Officer by way of Demand Draft besides making payment of `12,000/- towards arrears of maintenance. In case of non-compliance of the order, the complainant will be at liberty to approach this Court. 5.

The bail application stands disposed of.
