% 29.08.2018 Respondent no. 2 Mr. Sahil Kalra is present in Court along with his counsel and accepts notice. He has been identified by SI Munna Kumar of police station Delhi Cantt.

Learned counsel for the petitioner submits that petitioner (accused) and respondent no.2 (complainant) have settled their disputes amicably before the trial court on 18th December, 2017. Statements of petitioner and respondent no. 2 were recorded, on oath, by the Court on 6th January, 2018 regarding the settlement. Certified copies of the statements are at page 58-

59.

Respondent no. 2 says that he has received the settled amount of ₹75,000/- from the petitioner before the trial Court and he has no objection in case FIR No.83/2015 under Sections 279/338/379 IPC registered at Police Station Delhi Cantt. and consequent proceedings emanating therefrom are quashed.

Keeping in mind the settlement arrived at between the petitioner and respondent no. 2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and the consequent proceedings emanating therefrom are quashed.
