W.P.(CRL) 680/2017 Issue notice. Notice is accepted on behalf of the State. The petitioner has preferred the present writ petition to seek a direction to the Trial Court to pass an order on charge/ discharge at the earliest in case FIR 86/2010 under Section 448/420/467/468/471 registered at PS Begumpur, wherein the petitioner is an accused. The submission of the petitioner is that in the present case, cognisance was taken by the court on 13.07.2010. The charge

sheet was filed before the court on 21.06.2010. Since then, the order on charge has not been passed by the Trial Court. The petitioner has placed on record order sheets to show that the matter has been heard by two different judges on two occasions on the aspect of charge, but no order was passed. Such prolonged delay in the progress of the case has infringed the rights of the petitioner and put him to avoidable inconvenience. It is informed that the next date fixed before the Trial Court is 29.05.2017.

The petition is disposed of with a direction to the Trial Court to proceed with the arguments on charge on the said date and to pass the order on charge/ discharge positively within three months thereafter. The petition stands disposed of in the aforesaid terms. A copy of this order be communicated to the Trial Court.
