Counsel for the petitioner points out that in another complaint under Section 138 of the Negotiable Instruments Act where the petitioner was convicted, this Court has passed an order on 18th October, 2024 in CRL.M.C. 8194/2024 granting 30 days more time beyond the 60 days already granted by the Appellate Court for depositing 20% of the compensation amount, on account of petitioner's serious financial difficulty; he seeks the same relief in this matter.

2024 passed by the ASJ, Patiala House Courts in CC No. 3191/2022, proceedings under Section 138 of the Negotiable Instruments Act. 3.
Simple imprisonment for ten months and compensation for Rs.40 lacs was awarded against the accused and six months of simple imprisonment in default thereof.

The petitioner filed an appeal challenging the conviction on 27th August, 2024, the ASJ suspended his sentence on the condition that petitioner deposits 20% of the compensation awarded by the Magistrate within 30 days before the Court and furnish the bail bonds/sureties of Rs.50,000/-. 5.
In view of the assertions made by the counsel for petitioner, the impugned order is modified to the extent that petitioner shall deposit 20 % of the compensation amount within a period of 90 days from the date of the impugned order.

It is made clear that no further time shall be granted to the petitioner for the said purpose and in the event of failure in depositing, the petitioner shall have to undergo sentence awarded.

Petition is disposed of with the above directions. 8.
