% 24.10.2024 By way of the present petition filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks quashing of order dated 29.04.2024 passed by the learned Metropolitan Magistrate in Ct. Case No. 5199/2019 titled Narpal Singh vs. Anmol Singh, whereby the learned Magistrate while deciding an application under section 156(3) of the Code of Criminal The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Procedure 1973, had directed the registration of an FIR. The petitioner states that the FIR has not been registered yet. 2.

The petition is premised on Memorandum of Understanding dated 19.09.2024, whereby the petitioner and respondent No. 2 have resolved the matter amicably.

Learned counsel appearing for the parties submit that vide order dated 27.09.2024 passed in CRL.M.C. No. 7687/2024, this court has already quashed cross-FIR No. 91/2009 dated 13.05.2009 in terms of the same Memorandum of Understanding dated 19.09.2024. 4.

The petition is supported by affidavits of the petitioner and of respondent No. 2, alongwith proof of their I.D.s. 5.

Respondent No.2 has joined the proceedings via video-conferencing. 6.

In view of the settlement arrived at between the parties as comprised in Memorandum of Understanding dated 19.09.2024, the parties are ad-idem that their disputes be brought to a close and that no FIR be registered against the petitioner.

The court has interacted with respondent No.2, who also confirms the terms of the MoU; and undertakes that he shall remain bound by the terms of the MoU and shall perform his obligations thereunder. 8.

Mr. Utkarsh, learned APP confirms that the State has no objection to the subject FIR being quashed.

Accordingly, order dated 29.04.2024 passed by the learned Metropolitan Magistrate in Ct. Case No. 5199/2019 titled Narpal Singh vs. Anmol Singh is quashed. All proceedings arising therefrom also stand closed.

All parties shall remain bound by the terms of Memorandum of Understanding dated 19.09.2024 and shall perform their obligations respective thereunder scrupulously.
