Petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ('BNSS') has been preferred on behalf of petitioners for quashing of FIR No. 0415/2023, under Sections 420/406/34 IPC, registered at PS: Sarai Rohilla.

Learned APP for the State appears on advance notice and accepts notice. He submits that conditional anticipatory bail was granted to the petitioners subject to deposit of Rs.2,72,000/- vide order dated 13.05.2024 by the learned Trial Court but the same was cancelled vide order dated 18.09.2024, since the petitioners failed to honour the said condition. 3.

At this stage, learned counsel for petitioners submits that he may be permitted to deposit Rs. 2,72,000/- with the learned Trial Court in terms of order dated 13.05.2024 and with liberty to take appropriate steps for challenging order dated 18.09.2024. He also seeks to withdraw the petition with liberty to file afresh.

petition is accordingly disposed of with liberty, as prayed. Considering the facts and circumstances of the case, no coercive action shall be taken against the petitioners for a period of four weeks pursuant to order dated 18.09.2024, cancelling the anticipatory bail granted to the petitioners for enabling them to take requisite steps for challenging order dated 18.09.2024. Pending applications, if any, also stand disposed of. A copy of this order be forwarded to the learned Trial Court for information.
